1. Acceptance of Terms

By downloading, accessing, or using the Stillory mobile application and website (the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. You must be at least 18 years old to use the Service.

2. Description of Service

Stillory provides a whiskey collection management and tasting intelligence platform. The Service includes a free tier and a paid subscription tier ("Pro") with additional features, as well as optional one-time in-app purchases ("Buy Us a Pour").

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating an account. You may delete your account at any time in Settings > Account > Delete Account. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

4. User Content

You retain ownership of all content you submit to the Service, including collection data, tasting notes, and photos ("User Content"). By submitting User Content, you grant Stillory a non-exclusive, worldwide, royalty-free license to use, store, reproduce, and process your User Content solely to provide and improve the Service. You represent that you have all rights necessary to grant this license and that your User Content does not violate any third-party rights or applicable law. We do not claim ownership of your User Content.

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable law
Attempt to gain unauthorized access to any part of the Service or its infrastructure
Reverse engineer, decompile, or disassemble any part of the Service
Scrape, crawl, or systematically extract data from the Service without our written permission
Upload content that is defamatory, obscene, or infringes any third-party intellectual property rights
Interfere with or disrupt the integrity or performance of the Service

6. Subscriptions and In-App Purchases

Pro subscription:Pro subscriptions are auto-renewing and billed monthly or annually through the Apple App Store or Google Play Store at the pricing displayed at the time of purchase. Your subscription renews automatically unless cancelled at least 24 hours before the end of the current billing period. You may cancel at any time through your device's subscription settings (Apple: Settings > Apple ID > Subscriptions; Google: Play Store > Subscriptions).

Free trial (if offered): Any free trial will be disclosed at the time of offer. Unused portions of a free trial are forfeited upon purchasing a subscription.

Buy Us a Pour: One-time consumable purchases that support development. These are non-refundable except as required by applicable law or store policy.

Refunds: All purchases are processed by Apple or Google. Refund requests must be submitted directly to the applicable store. Stillory has no ability to issue refunds for App Store or Play Store purchases.

Price changes: We will provide reasonable notice of any subscription price changes. Continued use after a price change takes effect constitutes acceptance.

7. Intellectual Property

The Stillory name, logo, and all related trademarks, service marks, and trade names are the property of Stillory. The Service and its original content, features, and functionality are owned by Stillory and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use Stillory's trademarks or branding without our prior written consent.

8. Third-Party Services

The Service integrates with third-party services including Apple, Google, Supabase, PostHog, RevenueCat, and Google Gemini. Your use of those services is governed by their respective terms. We are not responsible for the practices or content of third-party services.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Stillory does not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Whiskey tasting notes, catalog data, and AI-generated identifications are provided for informational purposes only and may not be accurate or complete.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Stillory and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or profits, arising from your use of or inability to use the Service, even if advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid to Stillory in the 12 months preceding the claim, or $10 USD if you have made no payments.

11. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved in the state or federal courts located in Philadelphia, Pennsylvania, and you consent to personal jurisdiction in those courts.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the effective date and, where applicable, by in-app notice or email. Your continued use of the Service after changes constitutes acceptance. If you do not agree to the updated Terms, you must stop using the Service and may delete your account.

13. Termination

We reserve the right to suspend or terminate your account if you violate these Terms, with or without notice. You may stop using the Service and delete your account at any time. Sections 4, 7, 10, and 11 survive termination.
